Oregon Railroad-Crossing Injury Claims: Signals, Sightlines, and Train Evidence

Oregon Railroad-Crossing Injury Claims: Signals, Sightlines, and Train Evidence

After a serious collision at an Oregon railroad crossing, identifying the exact crossing is often the first step toward understanding what happened. The crossing’s public or private status, the warning equipment present, and the roles of the rail and road entities can determine which duties and records matter.

That work can be more complicated than finding the name painted on a locomotive. The track owner, train operator, dispatcher, signal maintainer, road authority, crossing owner, and vegetation controller may be different entities. Electronic data may be overwritten, equipment may be repaired, vegetation may be cut, and nearby video may disappear. Prompt, coordinated preservation can therefore matter even before anyone is prepared to reach a conclusion about fault.

This article concerns Oregon grade crossings used by freight railroads and other non-transit railroads, including public-road and private-road crossings. It does not assume that every industrial or plant railroad is covered by every federal rule discussed below; each federal part has its own scope and exclusions. Start With the Exact Crossing, Not Just the Railroad’s Name

Crossing identity provides the reference point for finding warning-system records, crossing orders, agreements, maintenance files, and train data. It also helps separate the entities that owned, operated, dispatched, or maintained different parts of the location.

Record the identifiers and movement details

As soon as practical, collect or write down:

  • the exact road or path and the tracks involved;
  • the incident date and time;
  • the U.S. DOT crossing number, if one is posted or can be located;
  • the ODOT crossing number and railroad milepost, if available;
  • the train’s direction of travel;
  • the road user’s direction of travel; and
  • whether the injured person was a motorist, cyclist, pedestrian, passenger, or minor.

The Federal Railroad Administration’s Rail Crossing Locator and Crossing Inventory can help identify a crossing, its Emergency Notification System information, reported warning equipment, railroad information, and collision history. These tools are useful leads, but they contain railroad-submitted information. They do not conclusively establish who owned or maintained a component, what condition existed on the incident date, or who was at fault. Preserve relevant historical entries and compare them with crossing-specific documents and scene evidence.

Determine whether the crossing was public or private

Public or private status matters because Oregon and federal provisions may apply differently to a public highway crossing, private roadway, or pathway.

Oregon law establishes a policy of uniform, coordinated railroad-crossing regulation, and ODOT has regulatory authority over Oregon public highway-rail grade crossings. ODOT may issue crossing-specific orders concerning construction, use, protective devices, maintenance, location, and cost allocation.

A private or farm crossing requires a separate analysis. Oregon law and rules impose specified sign requirements at certain private crossings without automatic protection, but ODOT guidance states that private crossings are not typically governed by a public crossing order apart from those requirements. Ownership, access rights, easements, contracts, railroad operating rules, and other crossing-specific documents may matter. Public-crossing horn rules and public-crossing responsibility allocations should not be applied automatically to a private crossing.

Identify Every Entity That May Control a Piece of the Crossing

Asking only “Which railroad was involved?” can conceal important divisions of responsibility. A better approach is to map each role and each physical component.

Build an entity map

Identify, where possible, the:

  • track owner;
  • train operator;
  • locomotive owner, if different;
  • dispatcher;
  • maintaining railroad;
  • warning-system or signal maintainer;
  • crossing owner;
  • road or path authority;
  • maintainer of any connection between crossing equipment and highway traffic signals; and
  • controller of the relevant right-of-way and vegetation.

One organization may fill several roles, but that should be verified rather than assumed. Oregon’s default rules can divide maintenance of the track area, highway, crossing circuitry, outside signal equipment, and vegetation between a railroad and a public authority. A crossing order or agreement may allocate those responsibilities differently. The actual equipment boundaries and right-of-way lines also matter.

Find the crossing order, amendments, and agreements

ODOT’s crossing-order system can be searched by the U.S. DOT crossing number, ODOT crossing number, railroad, or road authority. A crossing order is a legal document detailing crossing terms and assigning responsibilities. The useful record may include more than the latest order.

Depending on the crossing, relevant materials may include:

  • the original crossing order and amendments;
  • exhibits and as-built drawings;
  • easements and access documents;
  • construction-and-maintenance agreements;
  • contracts between rail, road, or signal entities; and
  • federal project and funding records.

These documents may help identify responsibilities, but they do not by themselves decide negligence, causation, or civil liability. Not every private crossing will have an ODOT crossing order.

Reconstruct What the Signals and Interconnections Did

A witness may remember that lights did not flash, a gate descended late, or traffic remained queued on the tracks. That account can be important, but warning-system operation should be tested against the equipment actually present and records with synchronized times.

Identify the warning system before evaluating its operation

First determine whether the crossing had only passive signs or included active lights, gates, bells, a predictor, an interconnected highway traffic signal, backup power, or a wayside horn. Do not assume that every crossing had each feature or that each feature produced a log.

Oregon’s general rule for listed active warning devices calls for continuous warning for at least 20 and no more than 40 seconds before a train traveling at the highest permissible speed reaches the crossing, unless ODOT orders otherwise. Applying that rule requires the actual device, permissible speed, train movement, crossing order, and any applicable qualification or exception. A witness estimate of warning time is not enough, by itself, to classify a malfunction or establish civil liability.

Preserve signal, malfunction, inspection, and repair records

Potential warning-system evidence includes:

  • signal or predictor event logs and diagnostic downloads;
  • circuit plans, configuration data, and native test records;
  • inspection, testing, adjustment, repair, trouble-ticket, and malfunction records;
  • Emergency Notification System reports and dispatcher or signal-desk notices;
  • highway-signal timing sheets, cabinet logs, and interconnection records;
  • relevant ODOT malfunction submissions; and
  • post-collision testing and chain-of-custody information.

Federal rules distinguish an activation failure, partial activation, and false activation. Those terms are not interchangeable. Classification depends on the device indications, warning time, train movement, speed, and regulatory qualifications or exceptions. For certain collisions involving a qualifying activation failure, federal rules require prompt telephone and written reports, but the filing of a report does not itself establish civil liability.

Federal rules also require specified malfunction, inspection-and-test, and Emergency Notification System records, with minimum retention frameworks for some records. Those requirements do not guarantee that every listed record exists or that an injured person can obtain it before litigation. Access can depend on ownership, consent, public-records law, subpoenas, discovery, and other rules.

Federal coverage must be checked for the operation involved. For example, Part 234 expressly excludes plant railroads and certain rapid-transit and insular tourist operations.

If an interconnected highway traffic signal may have failed, the investigation should determine who maintained each part of the system, who received notice, and what actions followed. Oregon’s rules divide specified duties in this setting and require a public authority to report to ODOT after certain reported malfunctions, but the actual interconnection and crossing documents must be verified.

Preserve the Incident-Date Sightlines and Crossing Conditions

“I could not see the train” is a starting point, not a complete sightline analysis. The relevant view is direction-specific and depends on the road user’s position, the train’s approach, and conditions at the time.

Document the view from the road user’s position

If it can be done safely and lawfully, photograph or record the crossing from the relevant approach and approximately the user’s eye height, looking in both track directions. Do not enter railroad property or stand where traffic or train movement creates a risk.

Document, where relevant:

  • the stop-clearance line or stopping location;
  • crossing skew and road and track grades;
  • train and road-user directions;
  • approach speed and track geometry;
  • the crossing surface;
  • vegetation, parked equipment, or other obstructions;
  • signs, lights, gates, and their alignment;
  • lighting, weather, sun angle, and seasonal conditions;
  • measurements, scene diagrams, and visible skid, gouge, or debris evidence; and
  • nearby homes, businesses, vehicles, or public systems that may have captured video.

Later photographs can be misleading if vegetation has been cut, equipment moved, lighting or weather changed, or repairs altered the crossing. Incident-date photographs, measurements, and original files are especially valuable. Keep original metadata and avoid editing the only copy.

Determine who controlled vegetation and the affected area

For motorists’ views, an Oregon rule assigns specified vegetation control on railroad right-of-way near a crossing to the railroad and assigns the public authority control on its right-of-way within the safe stopping distance. Applying that allocation requires proof of the right-of-way boundary, where the vegetation stood, its incident-date condition, and any crossing order or agreement that affected responsibility.

Work records, inspection records, complaints, photographs, and earlier reports may help establish when vegetation was present and who addressed it. The cited Oregon rule speaks to motorists’ views. A cyclist’s or pedestrian’s sightline theory requires separate analysis rather than automatic use of the same allocation.

Build a Train-Movement Timeline From Multiple Sources

The strongest reconstruction may come from correlating multiple clocks: locomotive data, crossing logs, dispatcher records, available video, vehicle data, emergency communications, and physical evidence.

Locomotive event-recorder and operating data

A qualifying train operating faster than 30 mph generally must have an event recorder associated with the lead locomotive that records the most recent 48 hours. Depending on the locomotive and recorder, modern data can include speed, time, distance, throttle position, brakes, horn control, headlights and auxiliary lights, consist position, and applicable train-control data.

A targeted preservation request may seek native data, metadata, software needed to read the data, calibration information, exact copies, and chain-of-custody records. Required channels depend on the locomotive and recorder, however, and private access is not automatic. Federal preservation requirements also must be applied to the actual reportable event.

Dispatcher, crew, train, and horn evidence

Other potentially relevant materials include:

  • dispatcher train-movement sheets and timetable information;
  • movement authorities, track warrants, bulletins, and mandatory directives;
  • train, engine, engineer, and conductor identifiers;
  • crew duty-time and qualification records;
  • consist, tonnage, train length, and brake-test records;
  • track class and authorized speed;
  • locomotive inspection records; and
  • applicable PTC, GPS, or telemetry data.

Federal rules require specified dispatcher movement records. The approved research did not identify a general federal requirement to record every radio or dispatcher conversation, so requests should cover recordings that actually exist without assuming there is audio.

For a qualifying public highway-rail crossing, the general federal horn pattern begins 15 to 20 seconds before the locomotive enters the crossing and continues or repeats until the locomotive occupies it. High-speed, quiet-zone, and other exceptions apply. This rule should not be applied automatically to a private crossing. Event-recorder channels, available recordings, and other records can be compared with witness recollections.

Available video and other electronic evidence

Potential recordings may come from locomotive, wayside, crossing, business, residential, traffic, dashcam, body-camera, or 911/CAD systems. They should be identified promptly because retention practices vary.

As of August 27, 2026, federal law did not impose a blanket camera mandate on freight locomotives. A freight railroad may voluntarily use an inward-facing, outward-facing, wayside, or crossing camera, but no recording should be promised or assumed.

Vehicle-side evidence may also matter, including EDR or ECM data, infotainment information, phones, GPS, dashcams, brakes, tires, and other electronic or mechanical evidence. Avoid destructive inspection, repair, disposal, or downloading over relevant data before appropriate guidance. Preserve native files and metadata so timestamps can be compared across the available sources.

Use Railroad and Public Records as Leads, Not Verdicts

Official forms and databases can identify records and help test a timeline. They should not be treated as final findings about fault.

Railroad and FRA reports

Federal rules require every highway-rail grade-crossing accident or incident to be reported on Form FRA F 6180.57 regardless of damage or casualty. A collision involving a qualifying activation failure can trigger separate telephone and written reporting requirements.

A report, public database entry, or later amendment may contain useful investigative leads, but it does not conclusively determine negligence or liability. Federal law bars the use in a civil damages action of any part of a covered railroad accident or incident report filed under 49 U.S.C. § 20901 or made under § 20902. That rule is distinct from the treatment of underlying signal data, locomotive data, photographs, physical evidence, witness information, and other independently created records, which require their own access and admissibility analysis.

ODOT, road-authority, NRC, and NTSB material

Possible official sources include ODOT crossing orders and project files; road-authority signal, maintenance, complaint, vegetation, and interconnection records; FRA inventory and safety data; National Response Center notifications; and an NTSB docket if one exists.

A grade-crossing fatality requires the railroad to notify the NTSB through the National Response Center within two hours. That notification does not mean the NTSB will conduct a field investigation. Check whether a public docket exists rather than assuming that one does.

A public-records request, preservation request, formal claim notice, subpoena, and litigation discovery request serve different purposes. One is not automatically a substitute for another.

Access and litigation use are also separate questions. Under 23 U.S.C. § 407 (formerly § 409), specified reports, surveys, schedules, lists, and data compiled or collected for covered federal highway-safety purposes are not subject to discovery or admissible or otherwise considered in a damages action. The protection is record- and purpose-specific and does not automatically cover every crossing order, maintenance record, photograph, signal log, or underlying factual record.

Why Evidence Preservation Cannot Wait

Evidence can change even when everyone involved acts in good faith. Electronic systems may cycle through data. Equipment may be tested or repaired. A damaged vehicle may be moved, salvaged, or altered. Vegetation may be cut. Debris may be cleared. Seasonal light and sightlines may change, and nearby surveillance may be deleted under ordinary retention practices.

Some federal rules require specified railroad records to be retained for a minimum period. That does not promise private access, and it does not make delay safe. Custody may be divided among the train operator, track owner, signal maintainer, road authority, crossing owner, and private camera owners. Preservation efforts should therefore identify the entity, system, date range, crossing, and requested data as precisely as possible.

Safe, lawful steps for an injured person or family

  1. Obtain medical care and prioritize immediate safety. Do not enter railroad property or return to an unsafe location to gather evidence.
  2. Write down the crossing details. Record the location, date and time, travel directions, and available crossing identifiers.
  3. Preserve originals. Keep original photos, videos, messages, device data, and vehicle evidence without editing, overwriting, or destructive testing.
  4. Identify witnesses and possible cameras. Note names, contact information, and camera locations without demanding access or interfering with an investigation.
  5. Avoid premature repair or disposal. Do not discard or materially alter important vehicle parts, devices, or files before obtaining appropriate guidance.
  6. Consider targeted preservation and records requests. Direct them to each entity likely to hold a particular category of evidence.
  7. Evaluate notice and filing deadlines promptly. This is especially important when ODOT or another public body may be involved.

A preservation request asks an entity to retain identified evidence. It does not necessarily compel immediate disclosure or create access that the law does not otherwise provide.

Federal Preemption Is a Claim-by-Claim Question

Federal railroad law can displace some state-law theories when federal law covers the subject. At the same time, 49 U.S.C. § 20106 preserves specified state damages actions based on a failure to comply with a federal standard of care, a railroad’s own federally required plan, rule, or standard, or a compatible state requirement.

Two U.S. Supreme Court decisions illustrate why the theory matters. In CSX Transportation, Inc. v. Easterwood, federal track-class speed regulations covered the excessive-speed subject, while the warning-device claim was not preempted on the facts because federally funded devices had not been installed. In Norfolk Southern Railway Co. v. Shanklin, state claims challenging the adequacy or type of warning devices were preempted once FHWA-funded devices were installed and operating.

Those decisions do not produce one answer for every crossing claim. Warning-device selection, maintenance, malfunction, federal noncompliance, vegetation, sightlines, crossing-surface conditions, speed, and train operations should be analyzed separately. Federal funding, device selection, installation, operational status, maintenance, and malfunction records should be obtained before drawing conclusions.

Comparative Fault and Deadlines Need Early, Individual Review

Questions about the road user’s actions and the time available to pursue a claim are important, but neither can be answered with a blanket rule.

A crossing rule violation does not answer the whole fault question

For drivers, ORS 811.455 requires stopping at the marked line—or, if there is none, 15 to 50 feet from the nearest rail—when specified signal, gate, flagger, visible-train, or audible-immediate-hazard conditions apply. It also prohibits driving through, around, or under a closed or moving gate.

Whether a trigger existed, what happened in sequence, and how any conduct contributed to the collision still require evidence. A driver-focused statute also should not be applied automatically to a pedestrian, cyclist, passenger, or minor.

Under ORS 31.600, contributory negligence does not bar recovery if the claimant’s fault is not greater than the combined fault of the persons the statute requires the factfinder to compare. Those persons can include parties against whom recovery is sought, qualifying third-party defendants, and persons who settled with the claimant. Any damages allowed are reduced in proportion to the claimant’s fault. An allegation that a road user made an error does not, by itself, eliminate a supported issue involving a warning system, maintenance, sightline, operation, or another entity’s conduct.

There is no single railroad-crossing claim deadline

An ordinary Oregon personal-injury claim generally has a two-year framework under ORS 12.110, while wrongful death generally has a three-year framework under ORS 30.020. Those are starting points, not a deadline calculation for a specific case.

If a public body may be responsible, the Oregon Tort Claims Act can require notice much sooner. ORS 30.275 generally provides 180 days for notice of a non-death claim and one year for wrongful-death notice, along with a generally two-year action period.

Public-body status, the claimant and claim, the correct notice recipient and method, actual notice, accrual, discovery, repose, survival, minority, extensions, and special statutes can change the analysis. A records request or preservation letter is not a substitute for legally sufficient Tort Claims Act notice. Prompt, incident-specific review is the safer course.

First Steps After an Oregon Freight-Train Crossing Collision

A practical first-week sequence is:

  1. Focus on medical care and immediate safety.
  2. Identify the exact crossing, its available numbers, and whether it was public or private.
  3. Map the rail, road, signal, and property entities instead of assuming one railroad controlled everything.
  4. Preserve original scene, vehicle, device, and available video evidence without unsafe access or destructive inspection.
  5. Seek the crossing order, agreements, inventory history, reports, and maintenance or operations records that fit the actual crossing.
  6. Evaluate notice and filing deadlines promptly, especially if ODOT or another public body may be involved.
  7. Obtain incident-specific legal advice before assuming who was at fault, which records are available, whether federal preemption applies, or how much time remains.

The goal is to preserve reliable information and identify the right entities and questions—not to reach a premature conclusion.
